We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for any reason, including a breach of these Terms.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
FitFocus and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruptions or cessation of transmission to or from the Platform; (d) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Platform by any third party; or (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Platform, whether based on warranty, contract, tort, or any other legal theory, and whether or not FitFocus is advised of the possibility of such damages.
These Terms are governed by and construed in accordance with the laws of NSW, Australia, without regard to its conflict of law principles.
We reserve the right to modify or replace these Terms at any time. Your continued use of the Platform after any changes to these Terms constitutes acceptance of those changes.
